Terms of Service

These Terms of Service govern website design, build, delivery, hosting, maintenance, and related services provided by The Sitesmith, a brand operated by Spencer & Hayes LLC. By purchasing a website build or maintenance package, you agree to the terms governing your website build, payment, delivery, and hosting. These Terms do not enroll you in SMS text messages. SMS is a separate, optional opt-in described in Section 10 and is never required to purchase, use, or receive any service.

The Sitesmith builds custom websites for service-based businesses. Each project is based on the information, preferences, business details, and revision requests you provide.

All payments are processed securely via Stripe. Work, revisions, and delivery begin after payment is confirmed. Stripe sends receipts directly. Build fees are as stated at the time of purchase and are non-refundable once the site has been built and delivered.

Your build includes a custom single-page website designed for your business. The client is entitled to one included revision round submitted via the revision form provided after payment. Additional revisions beyond the included round are quoted separately.

You are responsible for providing accurate business information, brand preferences, contact details, images, copy, account access, and any other materials needed to complete the site.

You confirm that you have the right to use any text, images, logos, trademarks, or other materials you provide. The Sitesmith is not responsible for claims related to materials supplied by you.

Your website preview is built from the business information you submit. After payment is received, you will receive a revision form for your included revision round.

Your included revision round allows you to submit all requested changes in one organized request. Requests should be clear, specific, and within the original project scope.

The 24-hour delivery guarantee applies when the completed revision form is received within 4 hours of payment confirmation. If this condition is met the finished site will be delivered within 24 hours. If the condition is not met the guarantee does not apply but the site will still be completed and delivered. The guarantee does not apply in cases of late or incomplete revision forms, missing business information, domain or DNS issues, third-party platform outages, payment delays, out-of-scope requests, or any client-caused delays.

Build-only clients receive finished website files for self-hosting. The Sitesmith also provides a step-by-step self-hosting guide for major hosting platforms.

Build-only clients are responsible for choosing a hosting provider, creating accounts, paying hosting or domain fees, uploading files, maintaining the website after delivery, and resolving issues with their selected hosting provider.

Managed hosting is available at $49 USD per month on all plans. A domain package is also available which includes a one-time domain registration fee of $25 USD in addition to the monthly hosting fee. Domain availability is subject to registrar rules and reasonable pricing. Premium domains are excluded unless agreed upon in writing. Hosting requires 30 days written notice to cancel. Upon cancellation reasonable transfer instructions will be provided but hosting and maintenance will end at the close of the billing period.

Clients may cancel monthly hosting at any time with 30 days written notice. The client owns their website. If a hosted client wishes to move their website and domain to their own accounts, a one-time transfer fee of $99 USD covers the administrative time required to hand over the website files and transfer the domain registration. Build-only clients receive their finished website files as part of their purchase at no additional cost. Once a transfer is complete The Sitesmith has no further obligations to the client. If no transfer is requested upon cancellation, the website and domain will be deactivated at the end of the cancellation period. Failed payments will result in the site being taken offline after 7 days. The Sitesmith is not liable for business losses resulting from downtime due to non-payment.

SMS text messaging from The Sitesmith (a brand operated by Spencer & Hayes LLC) is a separate, optional service that you may choose to opt into. Agreeing to these Terms of Service, purchasing a website, or using any of our services does not enroll you in SMS messages and does not grant consent to receive them. SMS consent is collected only through a clearly labeled, unchecked, optional checkbox on our website form, and is never a condition of purchasing, using, or receiving any service.

If you opt in, messages may include website project updates, appointment reminders, website previews, revision updates, delivery updates, onboarding follow-ups, billing-related reminders, and customer support. Message frequency is low volume, typically 2 to 3 messages per project. Message and data rates may apply. You may opt out at any time by replying STOP or request help by replying HELP.

Requests that materially change the original project scope may require a separate quote, a new timeline, or an additional service agreement. Examples include additional pages, custom applications, complex integrations, brand identity work, advanced copywriting, ecommerce functionality, or large content migrations.

After full payment is received, you own the final website content and finished website files created specifically for your project, excluding third-party tools, open-source software, licensed assets, platform services, and pre-existing materials owned by The Sitesmith or others.

The Sitesmith may display completed work in its portfolio or marketing materials unless you request otherwise in writing.

Refunds are limited to the 24-hour delivery guarantee as described above. The build fee is non-refundable once the site has been built and delivered. No refunds are issued for hosting fees after the billing period has begun unless otherwise agreed in writing.

To the fullest extent allowed by law, The Sitesmith is not liable for indirect, incidental, special, consequential, or lost-profit damages related to the website, hosting, third-party platforms, downtime, search ranking changes, business results, or client-provided materials.

No website can guarantee specific revenue, ranking, lead volume, conversion rate, or business outcome.

The Sitesmith may update these Terms of Service from time to time. The version posted on this page is the current version and applies to services purchased after the updated terms are published.
